Embattled ex-lawmaker, Hon. Chidi Duru has said the fresh N16.2million charge brought up again before the Federal High Court, Abuja is a replicate of the same charge brought up against him last year before the Lagos High Court in which EFCC struck out for lack of evidence.
A statement through his special assistant , Media and Strategy, Osita ogbuagu, Justice Atinuke Ipaye of the Lagos State High Court, Ikeja, says the former maker has been cleared of the same charges which were again coined to manifest in a new fresh trial in Abuja.
He said the Lagos state high court which charged Duru for stealing N16.2M also accused him of the intent to defraud, forged an ordinary resolution of FGPL dated 2nd June, 2008 purpating same to have been signed by all the subscribers/shareholders of FGPL whose purpeted signatures appeared there on. These charges which were withdrawn for lacking evidence were also filed again in a fresh hearing.
He added that Ayokunle Fayanju, a Nigeria prosecutor with EFCC has disposed an affidavit in support of the application for the withdrawal of the case for lacking evidence last year.
According to the source, Justice Atinuke in her enrolment of order on the same charges rule; “Upon this cause coming before this Honourable court on November 11,2016 for hearing pursuant to the application to withdraw criminal charge date 07/09/16 and filed 08/09/16 by the complainant in suit NO:ID/2039/15, is here by ordered as follows; “That the criminal charges No:ID/2039/2015, as ordered on the information, date 05/10/2015, is hereby struck out without prejudice.”
However, Duru’s second persecution on the same charge suffered setback as he was granted bail on self-recognition by Justice Peter Affen of the Abuja Federal High Court.
